What we collect and why
We collect personal information about licensees and third parties to help REA carry out its regulatory functions under the Real Estate Agents Act 2008 (Act) and other lawful functions and activities of the REA. These functions include:
- processing licence applications and renewals
- maintaining the register of licensees
- receiving and investigating complaints
- investigating potential offences under the Act
- analysing trends to create educational material.
The information we collect about licensees includes names, contact details, qualifications, employment and, where appropriate, criminal history.
Third parties include people such as complainants, witnesses, applicants for employment positions within REA, referees and people who contract with REA to supply us with goods and services. The information we collect about third parties includes names, addresses and contact details of those individuals.
Where we collect information from
We collect personal information directly from the individual concerned. We are also permitted to collect personal information about an individual from a third party in certain circumstances, including when:
- it would not prejudice the interests of the individual concerned
- it would prejudice the purposes of the collection to do otherwise
- the individual concerned authorises the REA to do so
- the information is publicly available information
- carrying out REA’s investigative functions as required by the Act
- is not possible in the circumstances of the particular case.
- the information will not be used in a form in which the individual concerned is identified.
Disclosure of information
Situations where we might disclose your personal information include the following.
If you are a licensee:
- some of your information will be made publicly available on the public register of licensees as required by section 66 of the Act
- and a complaint has been made about your conduct, some of your information may be disclosed to a Complaints Assessment Committee (CAC) or to the Real Estate Agents Disciplinary Tribunal (Tribunal) in accordance with Part 4 of the Act
- we may disclose your personal information to other third parties, such as Police or the Inland Revenue Department if permitted or required by law to do so.
If you make a complaint to us:
- copies of your complaint/objection will be disclosed to the person they are about and the relevant decision maker (a CAC, the Tribunal or the Registrar) in accordance with Part 4 of the Act
- we will disclose your personal information to other agencies if required by law to do so.
Access to your personal information
You are entitled to ask us to provide you with a copy of the personal information we hold about you. If you think personal information we hold about you is incorrect, you may also ask us to correct it.
If you have a privacy complaint about REA
If you have any concerns about how REA collects, manages, and/or uses your personal information, you may contact us.
If you are not satisfied with our response to any privacy-related concern you may have, you can contact the Privacy Commissioner and make a privacy complaint.
Access to the licensee portal
We may provide you access to the licensee portal via a RealMe login, which enables us to manage secure access to the services on our site.
You are responsible for keeping your RealMe username and password confidential. We will consider any activity on our site from your RealMe username and password to be undertaken by you.
By using our services, you agree that you will:
- notify us immediately if you know or have reason to believe that there has been or is about to be fraudulent or other unlawful use of our services
- confirm the information you provide us is true and correct before submitting your information.
For the protection of others, we may suspend or disable your access to our services without notice if we consider:
- such action is necessary to maintain the integrity or security of our services or any organisation or person
- the account is being misused or has otherwise been compromised
